BANGSAMORO AUTONOMY ACT NO. 27

Begun and held in Cotabato City, on Friday, the 29th day of March, 2019

AN ACT ESTABLISHING A LEVELHI DISTRICT HOSPITAL WITH ONE HUNDRED (1OO BED

CAPACITY IN THE MUNICIPALITY OF MAIMBUNG,PROVINCE OF SULU,AND APPROPRIATING FUNDS THEREFOR

Be it enacted by the Bangsamoro Transition Authority in Parliament assembled:

Section 1. There shall be established a Level II District Hospital with one hundred (100) bed capacity in the Municipality of Maimbung, Province of Sulu, which shall be under the direct administrative and technical supervision of the Integrated Provincial Health Office - Sulu (IPHO- SULU)

Any future increase in bed capacity and upgrading of health care services and facilities shall be based on the annual hospital development plan which shall be prepared by the Maimbung Hospital administration in coordination with IPHO-SULU.

Section 2. The Ministry of Health - Bangsamoro Autonomous Region in Muslim Mindanao (MOH-BARMM,specifically the Regulation and Licensing Enforcement Division (RLED),shall immediately include in the Ministry's program, the operational guidelines of a Level II facility with one hundred (100) bed capacity in accordance with the national Department of Health (DOH standards.

Section 3. Funding for Personnel Services (PS), Maintenance and Other Operating Expenses (MOOE) shall be included in the annual General Appropriations Act of the Bangsamoro.

Section 4. The Chief of Maimbung District Hospital, in consultation and coordination with IPHO-SULU, shall submit to the MOH-BARMM an annual operational plan reflecting the programs, projects, activities and budgetary needs for the operation of Maimbung District Hospital.

Section 5. The provisions of this Act are hereby declared separable, and in the event one or more of such provisions or part thereof are declared unconstitutional, such declaration of unconstitutionality shall not affect the validity of the other provisions not affected thereof.

Section 6. All regional laws, acts, decrees, executive orders, proclamations and administrative regulations which are inconsistent with the provisions of this Act are hereby amended, modified, superseded or repealed accordingly.

Section 7. This Act shall take effect after fifteen (15) days from its publication in a newspaper of regional circulation in the Bangsamoro Autonomous Region.
